What is mediation?

Mediation is a negotiation process, sometimes called an Alternative Dispute Resolution (ADR) process, for resolving conflicts in an amicable and rational manner.

What is Family Mediation Service?

Family Mediation Service is to help couples facing divorce/separation to resolve disputes in a non-adversarial way. Through the mediation process, the couple can reach a mutually acceptable and legally-binding settlement agreement. This rational and amicable mediation process, can minimize any negative impact of the divorce/separation on the parties and their children on the one hand, and promote their well-being on the other.

Targets: Couples facing divorce/separation

Scope of Family Mediation:

‧Care and parenting arrangement of children (Custody)
‧Time arrangement of access and visitation of parents and children (Access)
‧Living expenses and financial arrangement (Maintenance)
‧Division of assets

Characteristics of the Family Mediation Service

Emphasis on the welfare of the children

The well-being of the children is emphasized in the mediation process. Both parties’ motivation for the protection of the children is reinforced in the process. In this way, the focus could be put on the interests of the children instead of their individual positions so that they are more ready to accept common ways to attain the goal of protection of their children.
They are helped to identify the other party as the parent of their children instead of an ex-spouse.

Interest-based negotiation

The underlying interests and concerns of both parties are attended to. Their concerns are mutualized as common concerns as far as possible. They are facilitated to create, put forward and consider different alternatives to meet the concerns and benefits of both parties and the children. A win-lose concept is changed to a win-win concept.

Setting of clear goals and regulations

With the clear goal of settling an agreement, and different regulations like refraining from denigrating the other party and speaking for oneself, the clients are led to discuss issues together in a respectful environment.
The clients are made very clear that they are responsible for deciding the issues and outcome in the mediation process. The mediator is responsible for controlling the process so as to facilitate them to go on smoothly.

Trustful relationship between clients and mediator

It is important that the clients trust that the mediator is willing to help him/her to meet their needs. In the very beginning and in the process, the mediator recognizes their needs and underlying concerns, and acknowledges their emotions so as to remove blockages to mediation. Their opinions are valued as some of the alternatives for their solution.

A future-oriented perspective

The mediator will frequently redirect the couple to discuss on the future arrangement rather than the past events in relation to the divorce issues. This can prevent intensification of negative emotions towards each other. Their concerns or complaints are reframed to an expectation or proposals addressed to the other party so that an agreement can be worked out.

Cooperation between Lawyers and Mediators

In the delivery of Family Mediation service, clients are encouraged to seek their individual lawyers' advice to safeguard their legal rights. They are requested to consult their lawyers’ advice before signing the legally-binding agreement reached at the end of the mediation process.

Family Mediation Service Fee-charging Scale

Standard Rate : HK$1,000 per hour per person.

• Individual and joint interviews fees are calculated on individual basis;

• Both parties are required to pay the individual and joint interviews on individual basis according to the hourly rate;

• Payment of mediation fee to be made at the end of each interview.

Fees for Drafting Mediation Agreement

•  The first draft will charge each party for 2 hours of service.

•  The subsequent revised draft will charge each party for half hour of service for each revised version.

Remarks:

1. Submission of application form and income proof is required for applying fee remission. Standard rate will be charged UNTIL the required income proof is provided and fees paid are non-refundable.

2. The Society has the final discretion on the application for fee remission.

3. Legally-aided person is charged according to Standard Rate of HK$1,000 per hour per person. The other Party who is not legally-aided may apply for Fee Remission if need arisen.

4. Fees are charged according to a quarterly basis.

5. Effective date of fee-charging scale: 1st December, 2018.
